US court recognizes foreign child support order

In some cases child support disputes between parties can get complex. This is particularly true when child support cases involve enforcement of a child support order from a foreign jurisdiction. Given our global society, such cases are likely to happen more often.

In fact, our Florida residents may find it interesting to learn that a 48-year-old Hedge fund multi-millionaire who was ordered by a Hong Kong court to pay nearly $50,000 a month in child support payments to his ex-fiancée was unable to make a convincing case in favor of having his monthly payments reduced in a US court. His ex-fiancée happens to be a Hong Kong national, and the original child support case was filed in Hong Kong. The US court recognized and honored that court's decision. The couple was never married but has a child together.

Additionally, the judge also ordered the Hedge fund multi-millionaire to pay over half a million dollars in back owed unpaid child support payments that he owed his ex-fiancée for their 6-year-old daughter, as well as unpaid legal fees. However, he alleged that his ex-fiancée lied to the Hong Kong courts by claiming that money that she has been receiving from her current boyfriend were just loans. The presiding judge did not accept his argument that the US court not accept and enforce court rulings that have been rendered by courts in Hong Kong as they do for court rulings rendered in say London or Paris.

More importantly, the judge noted that since the 48-year-old was the one who initiated the original court proceedings in Hong Kong that are now being contested by him, the judge surmised that it was reasonable to presume that he was willing to abide by the courts ruling whichever way it went. Simply put, mere allegations of fraud do not meet the threshold for nullifying the Hong Kong court ruling, due to the doctrine of comity.
