Fighting to protect assets in a divorce

When Florida residents make big decisions, they likely consider all relevant factors that bear on the decision. Whether it be financial issues, emotional factors or other considerations, the best way to make an informed decision is to be knowledgeable about the different issues at stake.

Recently, this blog has discussed this decision-making process when considering whether to sell the family home after a divorce. There are a number of different factors that must be taken into consideration in deciding whether to keep the home in the process of asset division. There are also different factors the court will consider when distributing the home, including a consideration of whether it is in the child's best interests to remain in the home with the custodial parent.

Issues involving the distribution of the family home can be complex, as is often the case when there are valuation issues or choices over how to distribute debt. A noncustodial parent who does not want the marital home, for example, may try to inflate the home's value in order to get credit for that person's share in the property.

Moreover, the home may be just one of many different pieces of marital property that must be divided between the spouses. Other real or personal property may be at stake, and each may have different financial, emotional or other issues to address.

Our firm has extensive experience helping our clients decide how to handle the complex issues involved in dividing marital property. We work closely with our clients to determine their wishes with respect to various pieces of property, and we can then put in place a strategy to help our clients obtain the property they deserve.
