Navigating difficult property issues is key in a divorce

When Florida residents purchase or acquire property, there is no shortage of factors that must be addressed to handle the transaction successfully. From dealing with financing issues, to aspects of clearing title to the property and dealing with potential disputes with third parties, there are many things that must be considered.

In many respects, the process of dividing property in a divorce can be just as tricky, if not even more troublesome, because of the nature of the divorce itself. The spouses often have differing goals in the divorce, which can complicate the division of their property interests. For instance, the spouses may have different ideas of what the marital home or other jointly owned real estate is worth, as well as what should be done with that property.

Recently, for example, this blog discussed whether a party is entitled to setoffs or credits for the sale of the marital home. As with other property issues, there are a number of factors that must be considered in making this determination and these factors are set out under Florida law.

Our firm has experience in navigating through these difficult property issues that inevitably arise during a divorce. We work closely with our clients to understand what their wants and needs are, and we advocate vigorously in the divorce proceedings to realize those goals. Whether it is addressing unique property valuation issues or ensuring our clients' property interests are properly recognized, we do what is in our clients' best interests.
