Divorce settlements can be positive result with proper care

At a time when it seems like compromise is a dirty word, many Florida residents are often able to resolve their differences in even the most serious of disputes. This is frequently the case when it comes to litigation, including divorce litigation, as the parties to the case are able to work out their differences to settle the case without having to go through a full trial.

This is not to say that settlement agreements come easy or quick. To the contrary, even in many cases that are able to reach settlement, the settlement may come only after months of hard-fought litigation. Throughout this process, both sides are able to gather more information about the case, both in terms of the evidence that is in question and the position of the opposing party with respect to the issues. Individuals can also learn about how the law is likely to apply to a given dispute, which can influence their willingness to settle an issue.

As discussed last week in this blog, if the case is able to reach settlement, it is vital that the settlement agreement be properly drafted in order to fully resolve the dispute. The areas of agreement should not only be reduced to writing, but the provisions of the settlement agreement need to fully reflect the parties' intent on each issue, and the agreement should contemplate future disputes that may arise so they can be addressed at the present time.

Our firm works closely with our clients to understand what is important to them. We advise and advocate for our clients, including in cases where settlement may be the best option to resolve the matter. We can then draft an effective settlement agreement that properly handles all of the important issues being resolved, whether there are real estate interests at stake, business assets or other personal property.
