Proper valuation key when business assets at stake in divorce

Florida business owners understand there are many different factors that bear on the success or failure of the business. These factors can sometimes make it difficult to value the business.

As discussed recently in this blog, one of the key issues that must be addressed in a divorce is asset valuation. This can be a tricky process no matter what assets are at stake, but especially if there are business assets that are owned by one or both spouses.

Often, the spouse who gets to keep the business may come up with a lower valuation for the company than the other spouse. This is because the value of the business will be accounted for in the parties' asset division, and the other side is entitled to an offset for the value of the business assets that go to the opposing spouse.

The parties can not only have personal disagreements about the value of the business assets, they can also hire different financial experts who do not agree on the true value of the company. Accordingly, each expert's analysis and testimony may need to be considered by the court in determining how to value and divide the assets.
