Protecting parent-child relationships in Florida

There is perhaps nothing more important to Florida residents than the relationship they have with their children. Parenting can be both incredibly rewarding and challenging at the same time, particularly for parents dealing with custody issues following a divorce.

As discussed recently in this blog, when a court is in charge of making custody decisions between the parents, it is guided by what decision would be in the best interests of the child. This is a multi-factor test that considers many different aspects of each parent's relationship with the child.

While the law is the same in each case, the factors at play in each particular case can vary widely. Some factors in the best interests test may have more application to one case as opposed to another. Even if the same factors generally apply between different cases, one factor might sway the court's decision more than another as between these cases.

For instance, a parent in one case may be facing criminal charges. Accordingly, the court might consider the nature of those charges, what impact, if any, the charges have on the parent's relationship with the child and any other relevant issues at stake from the other case.
